Résumé

The legal inventiveness of contemporary African societies has not received the attention it deserves. A widespread prejudice too often consists in presenting the rules of law as a kind of artifice condemned to oscillate between mimicry and ineffectiveness, between extroversion and disembodiment.
To counter this popular misconception, the author gives ten examples, evoking ten themes touching on major legal issues, in which Africa has created, refined, enriched, or sublimated principles or institutions. Ten examples through which, while remaining firmly within the realms of modernity, the African continent can certainly claim a kind of precedence and, perhaps, exemplarity.
Firmly rejecting any vertical or monopolistic rationale, the book is based on the conviction that the development of law takes place in a horizontal mode of osmosis, hybridisation, and polycentrism. It is an exhortation to look at what is being done elsewhere, an invitation to listen and to explore new horizons.

    Malick Lazare DIAKHATÉ est doctorant en droit international public à l’Université Cheikh Anta Diop de Dakar et formateur à l’institut Dieng Consulting, spécialisé en droit public et en gestion publique où il prépare les candidats aux concours de l’École Nationale d’Administration (ENA), de la Cour des Comptes et de l’Inspection Générale d’État (IGE). Par ailleurs, il occupe le poste de Chef de l’Unité des affaires juridiques de la société publique Les Grands Trains du Sénégal (GTS-SA).

    Alioune SALL Alioune SALL is a university professor with a degree in literature and a lawyer. He has appeared as counsel before the International Court of Justice in The Hague, the UEMOA Court of Justice, as well as serving as a judge at the ECOWAS Court of Justice. Elected to the UN International Law Commission in 2021, he has written several books published by L'Harmattan, the latest of which, L'émotion et la Raison, is a reflection on relations between the African continent and international legal institutions.
